Healthcare Regulatory Updates & Valuation Implications

The healthcare regulatory environment has been in a state of constant flux since the start of the COVID-19 pandemic. The pandemic has resulted in numerous temporary regulatory changes that many in the legal industry believe may become permanent. Further, the federal government has taken (or indicated their intention to take) additional steps not related to COVID that impact the healthcare delivery system. This session will provide a review of the current healthcare legal landscape and discuss recent healthcare regulatory developments that affect our valuation engagements, such as:

  • The state of the national public health emergency and what will change once the public health emergency ends
  • The impact of COVID-19 and recent changes made to the Medicare Physician Fee Schedule on physician compensation and productivity survey data
  • Recent indications from the federal government related to future regulation of healthcare transactions involving private equity firms

This session will conclude with a discussion of the valuation implications of these various developments.
 

  • Analyze how the changes made to the 2021 Medicare Physician Fee Schedule affect the use of physician compensation and productivity survey data
  • Identify the regulatory waivers and relaxations that are still in place as a result of the Public Health Emergency and which of those may remain in place post-pandemic
  • Explain the steps the federal government is taking to scrutinize private equity firms that are becoming involved in healthcare transactions
